SATURDAY, FEBRUARY 24, 2024 The Hops for Houses Craft Beer Festival is a ticketed fundraising event benefitting Habitat for Humanity of Williamson County, TX, a 501c(3), Federal EIN: 74-2907371. Habitat Williamson County will act as the concessionaire and obtain the required temporary TABC permit. The Hops for Houses Craft Beer Festival is a 21+ event. Ticket sales & festival entry is limited to ages 21 and over; identification will be verified.

TERMS AND CONDITIONS: This Equipment Sponsorship Agreement is subject to the terms and conditions in this document. Sponsor has read, understands and agrees to be bound by these terms as a condition of its Equipment Sponsorship.

TERMS AND CONDITIONS AGREEMENT
This Equipment Sponsorship Agreement (“Agreement”) is by and between Habitat for Humanity of Williamson County, Texas (HFHWC) and the undersigned brewery (“Sponsor”) effective as of the date of execution here of by Sponsor (“Effective Date”), and sets forth the terms and conditions upon which Sponsor agrees to be an equipment sponsor of the Feb. 24, 2024 Hops for Houses Craft Beer Festival (“Festival”).

1. General. The Festival is organized by HFHWC, a Texas non-profit corporation.
2. Term. This Agreement shall be effective as of the Effective Date through February 24, 2024, the scheduled date for completion of the Festival (“Term”).
3. Festival Date. HFHWC will use its best efforts to conduct the Festival on February 24, 2024.
4. Festival Name and Logo. The HFHWC name and accompanying logo and the Hops for Houses Craft Beer Festival name and logo are owned by HFHWC. Equipment Sponsor does not have the right to use any of the aforementioned names and/or accompanying logos for promotional purposes.
5. Equipment Provided. Sponsor agrees to deliver to HFHWC for its use at the Festival all equipment necessary for the dispensing of Sponsor’s brands of beer at the booth where its products will be sold by the Festival’s designated concessionaire (“the Concessionaire”), including but not limited to, jockey boxes, tap handles, couplers, keg tubs, and pouring pitchers (“the Equipment”). Sponsor understands and agrees that HFHWC will provide the Equipment to the Concessionaire for its use at the Festival. The Equipment shall be delivered by Sponsor to HFHWC at the Festival site no later than Noon on February 24, 2024 (must be set up by Noon). The Equipment will be returned to Sponsor that day, as soon as practical, following the close of the Festival at 6:30 p.m., February 24, 2024.
6. Festival Cancellation. HFHWC shall not be responsible for damages that result from delays or postponements of the Festival due to circumstances beyond its reasonable control.
7. Insurance. Each party shall maintain, during the Term of this Agreement, insurance in the amount sufficient to cover liability for bodily injury, property damage and death arising out of the party’s activities that are the subject of this Agreement.
8. Relationship/Entire Agreement. The parties to this Agreement have no legal relationship other than as contracting parties to this Agreement. This Agreement represents the entire agreement between the parties and supersedes any prior understandings or verbal agreements.
9. Indemnity. Each party agrees to indemnify and hold the other harmless from and against any and all expenses, including reasonable attorneys’ fees, that the other party may incur by reason of any claim arising out of the indemnifying party’s negligence, intentional misconduct, performance or failure to perform pursuant to the Agreement, or any service or product sold or provided by the indemnifying party in connection with the Festival. All individuals provided by or associated with Sponsor who performs services at the Festival shall perform such services at the direction of, under the supervision and control of, and for the benefit of Sponsor. Sponsor shall be responsible, as between Sponsor and HFHWC, for any injuries or damages caused by or to said individuals.
10. Governing Law. This Agreement is performable in Williamson County, Texas and shall be governed by the laws of the State of Texas.

Brewery Set Up

All participating breweries must be completely set up and ready to serve by 12:00. VIP entry begins at 1 pm. Set up can occur as early as 10am the day of the festival, Saturday, Feb. 24. Instructions on where to check in will be sent out via email to the contact listed on this form by Monday, Feb. 19. Please note - as this is a tasting event, please do not bring in any cups, coolers or other containers for drinking out of. Requests for more information may be sent to [email protected]

Beer Check In

As the concessionaire, Habitat for Humanity of Williamson County requests that each participating brewery supply 2 (1/2) BBL Kegs for the festival. Invoices for the beer will need to be emailed to Habitat at least 2 weeks prior to the event. Check payments will be made at the door on the day of the event upon check in on Feb. 24. If using a distributor, Habitat will contact you for their information and make arrangements for payment and delivery of the beer. UNLESS USING A DISTRIBUTOR AND ARRANGMENTS ARE MADE PRIOR TO FESTIVAL WITH HFHWC, BEER CAN ONLY BE DELIVERED ON THE DAY OF THE EVENT, SATURDAY, FEB. 24 STARTING AT 10:00 AM TO THE FESTIVAL VENUE -THE WILLIAMSON COUNTY EXPO CENTER. Distributors who cannot deliver the beer on the day of the event will be able to make arrangements with Habitat and our partner brewery in Taylor for delivery there the day before on Feb. 23.

Volunteers

HFHWC will provide at minimum, one (1) TABC certified volunteer to pour the beer at each brewery station for the duration of the event (1pm - 6.30pm).

No outside tables are permitted. Please use the drop down menu above to choose if you need 1-6' table or 2-6' tables.

• This is a 21 and over event • Breweries must have a representative on site and at their booth at all times. • Beer may only be served in official logo tasting glasses (3oz plastic) • Vendors are prohibited from serving alcoholic beverages to any individual wearing a Designated Driver wristband. • Vendors are required to serve responsibly and may politely refuse service to anyone they feel to be too intoxicated. • No full bottles/cans/glasses may be sold or given away at this event. • No glass is permitted on the premise as per Williamson County Expo Center Rules. • Promotional items (t-shirts, hats, etc) may be given away ONLY but not sold

By submitting this application, I/We hereby agree to abide by the terms and conditions as defined in this contract set forth by Habitat for Humanity of Williamson County, TX (HFHWC). I/We agree to release HFHWC, its agents, and its volunteers from any claim arising from my participation in the program noted on the Registration Form. I/We grant permission for HFHWC to use participants images and/or captured/filmed during program activities to promote its services and programs. Your submittal indicates your understanding and acceptance of the conditions and terms detailed in this contract and agreement to participate in accordance with these rules
